TERMS AND CONDITIONS

  • King Club members (Members) can now earn 1000 Partner King Miles on spending Rs. 10,000/- and thereafter can earn 10 Partner King Miles for every Rs. 100 spent at any of the participating outlets of Skywaltz. (Hereinafter referred to as Offer).
  • Neither the employees or relatives of employees nor the families of Skywaltz or Kingfisher Airlines are eligible to avail of the Offer.
  • This Offer is valid from 29th December 2008 till 28th December 2009 (Offer Period).
  • Members should provide their King Club membership number while utilising any of the Skywaltz services. 
  • Members failing to register their King Club membership number at the time of utilising the services, may be able to avail of retro credit of Partner King Miles upto 180 days from the date of availing the service but in any case within the Offer Period, for which Members would be required to provide transaction details, i.e. the client agreement form number along with the date of availing the service.  Partner King Miles would be credited only on successful verification of the claims by Skywaltz.
  • Partner King Miles under this Offer would normally be credited within 4 to 6 weeks from the date of the realization of the payment made by the Member towards services utilised.
  • The Partner King Miles earned by the Members under this Offer may be redeemed only for the rewards available under the King Club programme.
  • Redemption of Partner King Miles earned on account of this Offer is subject to the redemption rules forming a part of the terms & conditions of King Club Programme.
  • Kingfisher Airlines and Skywaltz shall not be liable for any loss or damages whatsoever that may be suffered by any Member or any other person as a result of participating in this Offer.
  • The Ticket entitles you to participate in a hot air balloon flight experience at a particular date including:

    – The preparation and inflation of the balloon for hot air balloon flight
    – One hour flight in a hot air balloon
    – A commemorative certificate signed by the pilot

  • The Ticket is non-refundable and non-transferrable.
  • Hot air balloon flights are subject to weather conditions and are regulated by the Indian Aircraft Rules. It may be necessary to postpone a hot air balloon flight at any time if in Skywaltz’s judgment the conditions for the hot air balloon flight are not safe or the hot air balloon flight would not be permitted to operate under the Indian Aircraft Rules. Skywaltz will give you as much warning as operational procedures allows of any postponement but in order to ensure your safety Skywaltz reserves the right to postpone a hot air balloon flight at any time up to the moment of launch.
  • It is intended that the hot air balloon will be in the air for approximately 1 hour but the pilot has ultimate responsibility for deciding the duration and conduct of any flight and the appropriate time and place of any landing. Skywaltz and Kingfisher Airlines cannot guarantee that a hot air balloon flight will follow any particular direction.
  • If Skywaltz has to postpone your flight then you can ask for another date of flight as per your convenience and considering the availability. Alternatively this will invoke the right to ask for a refund.
  • Skywaltz will make you a refund less our reasonable administration costs (Clause 18) in the following circumstances; if you (as the guest) die or is incapacitated or it is certified by a doctor that there is no possibility that you will be or were medically fit to fly (other than by reason of pregnancy)
  • Refunds in any other circumstances are at our discretion.
  • Skywaltz’s administration costs are based on 25 per cent of the ticket price.
  • Skywaltz carry limited insurance cover against the risk of any injury to guests and their belongings during the course of our hot air balloons flights in accordance with international agreements covering such flights. The level of cover varies from time to time as a result of currency fluctuations and you may not consider it adequate. Skywaltyz can provide further details upon request and if you do not consider the amount of insurance cover would be adequate to compensate you for any loss whether for death, personal injury or damage to your belongings, you should take out your own additional cover. Skywaltz and Kingfisher Airlines will not be liable for any loss or damage to equipment and personal effects including clothing brought with you on the flight nor for death or personal injury above the level of our insurance cover unless it has been caused by Skywaltz’s willful misconduct.
  • Skywaltz and Kingfisher Airlines do not accept liability for any costs or expenses you incur if Skywaltz has to postpone any hot air balloon flight, where the reason for the postponement is beyond its control.

 Participant’s obligations to Skywaltz:

  • Ticket is valid for the specific date and time. If a hot air balloon flight is not boarded on that particular date and time without prior intimation and adjustment with Skywaltz then please consider the ticket utilised and invalid for future use.
  • Participant may postpone the hot air balloon flight up to 5 days before the meeting time for the flight, which has been booked depending upon the future availability.  If the future desired date in not available then you might have to get the ticket endorsed as open for hot air balloon flight for a later date.
  • If a notice of postponement in accordance with clause above or the hot air balloon is not attended in time to board booked flight, participant will not be entitled to a re-scheduled flight nor to any refund.
  • Skywaltz and Kingfisher Airlines are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly.
  • Participants must not fly if suffering from any serious medical condition, or have recently undergone surgery unless having a certificate of fitness to fly from a doctor.
  • A hot air balloon flight must not be taken at the time of pregnancy or under the influence of drink or drugs.
  • Our paramount consideration is for participants safety and the safety of others participating in the hot air balloon flight and participants must obey all requests and instructions issued by any of our representatives and take particular care to abide by any safety instructions given.
  • The pilot has complete discretion as to whether to allow participants to take part in the flight and will not allow doing so if in his opinion a participant would be a risk to the hot air balloon or to other passengers.
  • Skywaltz and Kingfisher Airlines will not fly children under the age of 5 years. A child under the age of 14 years will only be flown if accompanied by a responsible adult.
  • Participants should wear such appropriate clothing as is advised to you in advance of the hot air balloon flight.
  • Do not wear valuable clothes and shoes as sometimes deposits from the burners can cause staining on light colored clothing.
  • We often land in areas that require sports shoes.
  • On occasions participants may be required to move launch sites on the day of the scheduled flight, this move will only be due to adverse wind directions, so as to achieve the flight safely and within the rules of the aviation laws.
  • All must agree to be bound by these terms and conditions before flying with us.
  • Kingfisher Airlines and/or Skywaltz reserve the rights at any time to change, modify, withdraw, extend or terminate the Offer at their sole discretion without any prior notice and without any liability or obligation in this regard.
  • These Terms & Conditions shall be governed by and construed in accordance with Indian Laws.  Further, it is irrevocably and unconditionally agreed that the Courts of Mumbai shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes in any way relating to or concerning this Offer.
